    If your defense uses facts to poke holes in the story the prosecution lays out, you don't have to share that.

      • That is true..like i said, they don't have to show all their cards, but they have to present the basis of their defense. Any witnesses etc that is not part of that same basis is usually not allowed.

                            Well maybe that was a bad example. But if you are claiming insanity..they must disclose this and all reports of expert witnesses and such, along with their basis of defense. That is all i am saying.

                            They can't claim they are saying there client was not there then turn around and say he was insane. it is what discovery is.

                            • For instance your "stand your ground defense" starts before the trial. The defense files the motion to dismiss on the grounds of x y or z. Or the motion for anything really.

                              Then you have headings and testimony in front of a judge for that motion for him to accept or deny it. In this sense the prosecution has to "defend" against the motion.
