Shannon Burkenstein Show Listening Thread (week of 6/11/2012)
They can do it..but it has to be within the defense they are presenting..not a surprise subject..like now they are going to claim insanity 4 weeks in the trial.
No..they can't claim for instance, stand your ground..then turn around and bring in a witness saying the defendant is not capable of standing trial. They must disclose this to the prosecution. though it happens a lot, which results in mistrials.
