Yep judge fucked him. The clause in the contract rather explicitly defined that all xm subscribers be counted as Sirius subscribers and instead of reading it as that she felt that he had already been compensated.

Also she heavily relies on the fragmented Sirius subscription, and the xm subscribers.
Essentially you have 3 entities. Sirius, xm, and their owner Sirius xm.
The judge is saying that the contract was basically with Sirius, not Sirius xm or xm, and thus Sirius xm subscribers don't count as a part of sirius subscribers.

She definitely took an extra step to say that Sirius != Sirius xm.

Her interpretation would be passible if the 2 entered the merger on equal footing, but we know it was Stern who destroyed xm and caused them to seek the merger.

All the head Sirius people stayed on to call the shots of Sirius XM. It was far from being equal.
