Milk, I don't think you understand something about mj and this case.

He's not trying to say he isn't a public figure or that his wife isn't. He's saying you don't have a right to say these things or detract from him without his consent. He's saying that all these statements are being taken as fact and used against him and he's arguing that those things can't be stated because of how they might be interpreted.
He's attacking the first amendment because all these statements and events have made him uncomfortable.

To me he is saying he is only a public figure when it benefits him, other than that him and his wife are off limits and not public figurines to anyone else. However you want to interpret it, it is still all a joke.
