Nielsen called it “a blatant shotgun pleading.” The words came in its ask of a Florida court to toss a counterclaim filed by Bubba “The Love Sponge” Clem accusing the measurement giant of conspiring with Cox Media Group in a “sting operation” to entrap the host into engaging in ratings distortion.
In a motion to Dismiss Defendants/Counterclaim-Plaintiffs’ Counterclaim, Nielsen says the conspiracy theory claim, with all of its “wild and far-fetched accusations,” should be tossed in its entirety. “The Counterclaim consists of page upon page of irrelevant factual allegations with the thinly disguised purpose of slinging mud at Nielsen’s reputation,” Nielsen attorney Mark Ragusa writes in the 12-page Motion filed in U.S. District Court for the Middle District of Florida. “Even if there were any shred of truth to these purported facts, which there is not, Defendants make virtually no attempt to link any of these allegations to the elements of the specific claims being pled.”
