I think you would find that, for different reasons, all parties involved lied in their depositions and testimony. Kinda hard to put someone on the stand when previous statements turned out to be lies/ misleading.

"But in your deposition, Mr Clem, you said X but you are now telling us Y."

Well, when one of the people involved used to be a fed prosecutor, the good ole boy network is in full effect there too. Happens all the time at the Fed level.

It's true they rarely lose when they take cases to court...but how many never see the light of day?

Whether that is what happened here, we may never know. But to think it doesn't happen is naive as hell.
