I believe the police investigation revealed that in at least one of the other DVDs, it is clear that Hogan knew he was being taped. Denzil said he knew he was being taped.
Hogan also has flip flopped on his knowledge of 'the security cameras' at Bubba's house.
And while on the subject of the security cameras, they make it sound like this elaborate system that everyone knew about. Fact is, beside the cuckold camera, it was a 4 camera setup that could be easily lost in a McMansion. I have 2x the cameras around a house 1/2 the size.
My feeling is when people refer to 'the security cameras' at Bubba's house, they are actually talking about the cuckold camera.
Dave Rice testified that the camera was in plain view on top of a kitchen cabinet in Bubba's bedroom. I always figured it was a hidden cam, and yes Bubba has a kitchen in his bedroom.
Dave Rice also said the DVD was in plain view in his closet and for some reason it was common for guests to end up in his closet. You have to wonder what guests were doing in his closet, but I guess everything makes sense after you bang your friends wife with him watching.
I'm pretty sure Hootie knew,I wouldn't be surprised to find out he and Bubba are in cahoots on all of this.

I figure that Hogan knew the scene was being taped. Hell, he lived in that house for awhile.

The operative concept is reasonable expectation of privacy. Was the Hulkster entitled to to it?

If so, Bubba would be charged criminally. The fact that he wasn't speaks volumes.

Well, the illegal taping, if it was, happened in Pinellas County. The stealing of it took place in Hilsborough, which is what Ober refused to prosecute.
