Yeah I don't see why it would be relevant for this case. He really has nothing to do with Gawkers actions, which is what this is about.

I think it would be pertinent to know whether Hootie knew he was being filmed and if Bubba could verify it, I think that's a big deal.

Has nothing to do with Gawkers right to publish it. If he knew it was being taped so Bubba could jack off, that doesn't give them permission to post it without permission.
