Playing Devil's advocate for just a second, Ellis is workin smart here. He knows they lost and might have one inkling of a chance to get this thrown out and is trying his damnedest. That being said, this is really a bullshit move and hopefully the judge sees through it and that the Jury has no knowledge and the case can move on.
