I don't know if him being told after being recorded matters. Well, it's up to a judge or jury to decide on whether the law applies. Bubba needs to save face and apologize regardless.

If the "ex employee" scenario is true, at the very least it allows for Bubba to apologize and make amends. It will take a long time for anyone to ever trust him again, but at least he can make it right. He can begin by strapping himself into the torture rack and letting Hogan repeatedly kick him in the nards.

If this whole media assault is a result of Bubba acting alone though? He's just not the man I imagined him to be.
